These Terms of Service ("Terms") govern your access to and use of the znowsoft.com website, your ZnowSoft account, the licences you buy through it, and our API (together, the "Service"). By creating an account, buying a licence, or using the Service, you agree to these Terms. Individual products may add their own terms, which apply in addition to these.
1. Your account
You must give an accurate email address and keep your credentials secure. You are responsible for activity under your account. Tell us promptly at info@znowsoft.com if you believe it has been compromised; you can end every active session yourself from your account page. You must be at least 13 years old to hold an account.
2. Licences
A licence grants you a non-exclusive, non-transferable right to use the product and tier you purchased, for the term you purchased, subject to that tier's seat and activation limits. Licence keys and activation credentials are issued to you and must not be shared, resold, or published. We may suspend or revoke a licence that is being shared or used to circumvent those limits.
Some entitlements are granted by us at no charge — for evaluation, support, or internal use. Those may be withdrawn at any time and carry no warranty or service commitment.
3. Payment, renewal and refunds
Prices are shown at checkout and payments are processed by Stripe. Subscriptions renew automatically for successive terms until cancelled; you can cancel at any time from the billing portal, and cancelling stops the next renewal rather than the current term. Deleting your account does not by itself cancel an active subscription — cancel it first, or ask us to. Taxes are applied as required by the jurisdiction indicated by your billing and payment details.
4. API and credentials
API keys and OAuth clients are issued with specific scopes and rate limits, and must be used only within them. Do not attempt to exceed, evade or probe those limits, use a credential beyond its scopes, or share a credential outside your organisation. We may rate-limit, suspend, or revoke a credential to protect the Service. Credentials that we bundle inside distributed software identify the application, not you, and confer no rights beyond their stated scope.
5. Acceptable use
Do not use the Service unlawfully, to harm us, our providers or other users, to send spam through our contact or mail features, to submit deliberately false telemetry or other data, or to attempt to gain access to accounts, data or systems that are not yours. Do not reverse engineer, decompile or circumvent the licensing or activation mechanisms except to the extent that right cannot lawfully be excluded.
6. Privacy
Our Privacy Policy explains what the Service and our products collect, including product telemetry, and forms part of these Terms.
7. Intellectual property
All content on the Site and in our software, including text, graphics, logos, product names (such as ZenStork, ZenHoot, ZenTrail, ZnowPulse, ZenSailor and ZenYap), and the software itself, is the property of ZNOWSOFT, LLC or its suppliers and is protected by international copyright and trademark law. Your licence grants use, not ownership, and transfers no rights in our intellectual property. You may not reproduce, distribute or create derivative works from any part of it without our express written permission.
8. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate access for a material breach of these Terms, for non-payment, or where required by law — and, except where a breach is serious or repeated, we will tell you why and give you a chance to put it right first. Sections 7, 9, 10 and 11 survive termination.
9. Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding its operation, content or materials, and do not warrant that it will be uninterrupted or error-free. Nothing here excludes a warranty or right that cannot lawfully be excluded, including the statutory rights of consumers.
10. Limitation of liability
To the fullest extent permitted by law, ZNOWSOFT, LLC is not liable for indirect, incidental, punitive or consequential damages, or for lost profits or lost data, arising from your use of the Service. Nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which ZNOWSOFT, LLC is registered, without regard to its conflict of law principles. Where you deal with us as a consumer, this does not deprive you of the protection of the mandatory law of your place of residence.
12. Changes
We may change the Service, our policies and these Terms. We will revise the date above when we do, and give notice of material changes on the account page. Continuing to use the Service after a change takes effect constitutes acceptance of it.
